One of the substantive issues tendered for consideration on this appeal is whether it was proper to permit the prosecutor on cross-examination to impeach an eyewitness to defendants arrest, called by the defense, for failure to report to law enforcement authorities or the office of the District Attorney exculpatory information to which he testified on trial. The Appellate Division held that the issue had been preserved for appellate review and that such cross-examination was "unfair and improper" and "impinged upon defendants right to a fair trial", mandating a new trial (65 A.D.2d 405).
